I. Terms and
Conditions of WiFi Access Use
Computers & Tele-Comm, DBA CTC Wireless Internet, an iBroadband Company; hereafter CTC, grants the user hereafter referred to as the client, a non-exclusive single use of this WiFi Access point, and a shared connection to the net. Hereafter referred to as the service. This service at basic speeds is provided as is where is free of charge and subject to the following rules and conditions:
II. Material and
Products:
1. Client will abide by the posted rules and regulations in this document, where placarded and on splash pages navigated to use the service. Client must refrain from attempts to gain exclusive use or to the monopolization of resources on the service. Client acknowledges that data transmitted via this AP is not secure. CTC shall make no effort to validate this data or information for content, correctness or usability, unless paid for this review.
2. Use of CTC's service requires a certain level of knowledge in the use of Internet languages, protocols, and software. This level of knowledge varies depending on the anticipated use of our connectivity, and/or desired content of Client's connection by the Client. Client agrees that uploading of Client data to CTC and all other support provided by CTC, our partners and sponsors is as is where is and we collectively assume no responsibility for merchantability or fitness. All use of the service is the sole responsibility of the client with no guarantees provided.
3. CTC will exercise no control whatsoever over the content of the information passing through the network, except as directed by the Client in the form of files posted, and or changes requested by the Client by e-mail or by writing. CTC provides hosting services and connections to the Internet, makes available Server space, and provides online consulting. CTC does not own or control the Internet and makes no warranties or representations of any kind, whether expressed or implied for the Internet service it is providing or as to the nature of the Internet. CTC also disclaims any warranty of merchant-ability or fitness for particular purpose and will not be responsible for any damages that may be suffered by the Client, including loss of data resulting from delays, non-deliveries or service interruptions by any cause, or errors or omissions of the Client. Use of any information obtained by way of CTC is at the Client's own risk, and CTC specifically denies any responsibility for the accuracy or quality of information obtained through its services.
4. Connection speed represents the speed of a connection to us and does not represent guarantees of available end-to-end bandwidth. CTC expressly limits its damages to the Client for any non-accessibility time or other down time to the prorated monthly charge during the system unavailability, or to the provisions of our up-time guarantee. CTC specifically denies any responsibilities for any damages arising as a consequence of such unavailability. .
III. Internet
Etiquette:
Electronic forums such as mail distribution lists and Use Net news groups all have expectations regarding subject area and appropriate etiquette for posting. Users of these forums should be considerate of the expectations and sensitivities of others on the network when posting material for electronic distribution. The network resources of CTC may not be used to impersonate another person or misrepresent authorization to act on behalf of others or CTC. All messages transmitted via the Direct Connection, the service, Electronic Mail, or FTP Services should correctly identify the sender; users may not alter the attribution of origin in electronic mail messages or posting. Users must not attempt to undermine the security or integrity of computing systems or networks and must not attempt to gain unauthorized access. CTC expressly disallows the use of unsolicited commercial e-mail (UCE) commonly referred to as SPAM. Bulk e-mail of more than 250 messages per hour or at one time must be done via a list server, or e-mail server provided for the purpose, and the Client must meet all applicable Federal, State and local regulations in regard to its use. Violation of this provision is cause to suspend all connections for the Client without notice.
IV. Limited Liability:
1. Client expressly agrees that use of the service or connection is at Client's sole risk. Neither CTC, its employees, affiliates, agents, sponsors, third party information providers, merchants, licensers or the like, warrant that CTC's Server service will not be interrupted or error free; nor do these make any warranty as to the results that may be obtained from the use of the service or as to the accuracy, reliability or content of any information service or merchandise contained in or provided through the CTC service, unless otherwise expressly stated in this Agreement. Not withstanding the provisions of this section, CTC will use its best efforts to maintain, diagnose and supervise the connections to the Client so as to provide 99 % uptime for the connections supplied. Connections that are unavailable to the service, and/or Dedicated Servers, except as provided by the maintenance of those Servers, and section III-3, will be compensated by a two-for-one replacement of the time involved for any service that is actually paid for to CTC by subscription or under contract. Should the failure be caused by CTC upstream providers the two-for-one replacement provision is void and credit will be based on actual time involved. The credit for this will be placed on the following month’s invoice.
2. The sponsors of this specific service, locations for transmitters and facilitators of the services including our sponsors, partners, and the City of Kansas City specifically disclaim any and all liability for use, such use is solely the responsibility of the Client.
3. Maintenance provisions: All computer equipment requires periodic maintenance. As such, a maintenance window of 20 minutes per 24 hours is considered reasonable and expected downtime. Such maintenance will normally be performed at low utilization hours, such as nighttime and early morning, or at such times as are mutually agreed upon. Additional maintenance may from time to time be scheduled with prior notification to the Client. Should the Client require exceptionally high availability (such as during trade shows or other marketing or public demonstrations), a bypass of the maintenance provisions is acceptable with 24 hours notice.
V. Lawful Purpose:
Client may only use the service for lawful purpose. Transmission of any material in violation of any Federal, State or Local regulation is prohibited. This includes, but is not limited to copyrighted material; material legally judged to be threatening, obscene, pornographic, or profane; or material protected by trade secrets. This also includes links or any connection to such materials.
